Terms of service
Plain summary, which is not the agreement but is what the agreement says: month to month, cancel any time, your number is yours and leaves with you, you're responsible for having permission to text the people you text, and there are two things this service is not — it is not a replacement for 911 and it is not a substitute for your own judgement on an emergency call.
ContractorCX is a service of TEAMTREMAINE LLC, an Ohio limited liability company, entity number 4906263. ContractorCX is a registered trade name of TEAMTREMAINE LLC. In this document, "we", "us" and "our" mean TEAMTREMAINE LLC trading as ContractorCX.
1. The agreement
These terms govern your use of the ContractorCX website and, where you are a customer, the telephone and messaging service we provide to your business. Using the service means you accept them. If you have a separate signed order or service agreement with us, that document controls where it conflicts with this page.
2. What the service is
ContractorCX provides business telephone and messaging services for residential home-services contractors. We answer inbound calls to a business number we operate for you and route them to ordinary telephone numbers that you nominate — typically the mobile phones your people already carry. We send and receive text messages on that number.
There is no application to install, no software dialler and no in-browser telephone. Your people's handsets are not modified in any way and place and receive calls exactly as they do today.
3. ⚠ Emergency calls — 911
The ContractorCX service is not a replacement for your telephone service for emergency calling and must not be relied on to reach 911.
Because we do not install a dialler on anyone's handset, an emergency call placed from your or your people's own phones is an ordinary call on their own mobile or landline service, routed by their own carrier with their own location information. We are not in the path of that call. Keep a working telephone service capable of reaching 911 at every location and on every handset your people use.
4. Your responsibilities
- Consent to message. You are responsible for having the consent you need from the people your business texts, and for honouring opt-outs. We will register your messaging with the carriers, we will build opt-out handling into the service, and we will stop a message we are required to stop — but the relationship with your customer is yours.
- Lawful use. No unlawful, harassing, misleading or fraudulent calls or messages. No content prohibited by the carriers.
- Accurate information. Including the business details we file on your behalf with carriers and registries, and any service address you give us.
- Your account. Keeping your own login credentials to yourself.
5. Numbers and porting
Where we port an existing number for you, you confirm you are authorised to move it. Porting timelines are set by the carriers and are outside our control. Your number is yours. If you leave, we will release it to your new provider and we do not impose a waiting period before doing so.
6. Fees, term and cancellation
Service is month to month unless a signed order says otherwise, and you may cancel at any time. Fees, any included allowance, and any usage charged above it, are as stated on our pricing page or in your written order. Usage is billed on true measured duration in seconds, not rounded up to whole minutes. We will not apply a rate to your account that was not published or agreed with you in writing beforehand. Taxes and regulatory fees are your responsibility where they apply.
Founding-customer arrangements are as described on the pricing page, and the pricing offered to a founding customer does not expire when general pricing begins.
7. Call recording
Call recording is off unless you turn it on. If you turn it on, everyone on the call is notified at the start of the call. You are responsible for using recordings lawfully. Recordings and voicemail are retained for 90 days unless we agree otherwise with you in writing.
8. Automated answering
Where automated answering is enabled on your account, callers are told they are speaking to an automated system. Automated answering is a convenience and not a professional judgement. It does not diagnose, does not decide whether a situation is dangerous, and must not be relied on as the only thing standing between a caller and an emergency. You remain responsible for how your business responds to what a caller tells it.
9. Availability
We work hard to keep the service up and we depend on carriers and infrastructure providers we do not control. We do not promise uninterrupted service. Where a written service level applies to your account, it is in your order.
10. Our intellectual property
The service, the software behind it, and the ContractorCX name and marks are ours. Nothing here transfers them to you. Your data is yours; you grant us only the permission we need to run the service for you.
11. Disclaimers and limitation of liability
To the fullest extent the law allows, the service is provided "as is" and we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost business, and our total liability arising out of the service is limited to the fees you paid us in the three months before the event giving rise to the claim. Nothing here limits liability that cannot lawfully be limited.
12. Termination
Either party may end the agreement on written notice. We may suspend service immediately for unlawful use, for non-payment, or where a carrier requires it. On termination we will help you move your number out and will make your data available to you for a reasonable period before deleting it.
13. Governing law
These terms are governed by the laws of the State of Ohio, without regard to conflict-of-laws rules, and the state and federal courts located in Ohio have exclusive jurisdiction.
14. Changes
We may update these terms. If a change materially affects customers, we will tell them directly. The date at the top always reflects the current version.
